RMT Takes Forward Agency Workers' Campaign

We note the appointment of Brother Hogg as lead officer for RMT members employed through Trainpeople.co.uk staffing agency.

We instruct the General Secretary to arrange a meeting at Unity House with the Assistant General Secretary, lead officer, General Grades Committee members and a nominated representative of each Regional Council to discuss the organisation of workers employed through Trainpeople.co.uk. A report of this meeting to be placed back in front of this General Grades Committee.

To assist with our mapping exercise, we instruct the General Secretary to write to all railway companies asking whether they use labour supply agencies, which agencies including Trainpeople.co.uk, where, how much they are paid and for what work. we also reiterated that railway work in the grades collectively represented by RMT should be performed in-house by workers on permanent contracts.

We further instruct the General Secretary to write to all our Regional Organisers to ensure that any and all instances of the use of agency labour in the companies they have responsibility for are to be reported and placed in front of the General Grades Committee for consideration and that no agreements are made by any of our representatives which would see the outsourcing of our members’ work. Any such proposals from the companies are to be reported and placed before this General Grades Committee.

We further note the meeting and correspondence between RMT and London Underground Ltd concerning our belief that LUL is failing to meet the requirements placed upon it by the Agency Worker Regulations 2010. We note the response from LUL’s Director of Employee Relations stating that they believe that they are acting in line with the Agency Worker Regulations. Therefore we instruct the General Secretary to arrange a meeting with our legal advisers, full-time officer and members concerned to discuss the prospect of legal redress. the legal advice following this meeting is to be placed in front of this General Grades Committee for consideration.
