With 44 years service and only 13 working days until his retirement, Steve Hover, a respected and well-liked Loughton driver, was summoned to attend a Local Disciplinary Interview (LDI) for infringing LUL’s punitive sickness policy, and given a vindictive 23-week warning.

Members are aware that the image of Arwyn and Eamonn is iconic and symbolises the victimisation disputes last year. Off the back of that campaign about another 10 members jobs across the combine were saved as LU backed off. As the badge says "solidarity wins!"

Submitted by Janine on Thu, 17/11/2011 - 17:00RMT General Grades Committee decision:
That we note the correspondence on file and that agreement has now been reached that allows James Masango to return to work and that he has accepted the offer from his employers. This has been achieved after protracted negotiations with London Underground that eventually resulted in a satisfactory conclusion to this whole sorry saga. We congratulate our members and all those involved who helped achieve an acceptable conclusion to this matter.

We note that Jayesh Patel has accepted reinstatement to his substantive role as a train driver from February 2012. We note that this is a huge reduction in the sanction initially imposed on him by London Underground.
We also note that London Underground has agreed to reinstate James Masango, but that the terms of this reinstatement are still under discussion.

RMT Launches Campaign And Prepares To Ballot In Fight For Justice For Unfairly Dismissed Tube Driver
Submitted by Peter on Tue, 11/10/2011 - 14:02TUBE UNION RMT today launched a campaign for the reinstatement of tube driver James Masango who, despite winning by 100% an Employment Tribunal claim for unfair dismissal, has still not been re-engaged by London Underground.
James Masango’s case exposed an appalling litany of mismanagement which resulted in his Tribunal taking the rare step of finding 100% in his favour with not a single shred of evidence that there was any contributory fault on his part. Reinstatement in light of such an overwhelming verdict on his innocence should be automatic.
Act Now to Win Justice for James!
Submitted by Janine on Thu, 06/10/2011 - 17:04RMT General Grades Committee decision:
That we are utterly disgusted by London Underground’s continuing refusal to reinstate James Masango despite the Employment Tribunal ruling two months ago that LU had dismissed James unfairly and with the company 100% to blame.
The formal processes have failed to reverse this shocking injustice. We therefore instruct the General Secretary to, without any further delay, implement our previous decisions on this matter, and specifically to:
Justice for James!
Submitted by Janine on Thu, 29/09/2011 - 12:09RMT General Grades Committee decision:
We note the legal opinion received in this case. Accordingly, we instruct the General Secretary to immediately raise a formal complaint with the Office of the Rail Regulator that London Underground endangered the safety of both its employees and the public, in breach of the Health and Safety Act 1974.
We further instruct the General Secretary to advise Brother Masango as to his rights to pursue a personal injury claim, as outlined in the legal advice.

We instruct the General Secretary to seek a meeting with the Director of Employee Relations to seek clarification on the content of the letter and pursue further progress with this case.

RMT to Fight for Justice for Jayesh
Submitted by Janine on Thu, 08/09/2011 - 17:00RMT General Grades Committee decision:
Following our previous decision of 22 June, we are appalled that London Underground has upheld the unjust downgrading of Jayesh Patel at appeal.

RMT Demands Reinstatement of James Masango
Submitted by Janine on Thu, 08/09/2011 - 10:35General Grades Committee decision:
We note that the Employment Tribunal found on 17 August that London Underground dismissed Victoria line driver James Masango unfairly, that London Underground unreasonably required him to drive a train when he was not fit to do so, and that James made no contribution to his dismissal. This is a shocking case, in which LU management’s determination to force its employees to work whether or not they are fit to do so has resulted not only in an unfair dismissal but in putting the travelling public in danger.
