Update on 'breach of core working agreement' dispute

BREACH OF CORE WORK AGREEMENT, CONTRACTING OUT AND USE OF SECONDARY SUBCONTRACTORS – FLEET GRADES – LUL (LUL/13/1)

Further to my previous Circular (IR/253/16, 25th August 2016), in which I advised the NEC had taken the decision to ballot all LU Fleet members over BTUK controlled S-Stock Shoe Gear Replacements and Air-Bag Replacements and Breaches of the Fleet Core Work Agreement. Following discussions with the Company, an assurance was received for improved consultation in the future and a commitment given to retaining core maintenance activities within the Fleet organisation. Following consultation with LU Fleet Reps the NEC noted that the Reps were monitoring on-going talks between London Underground and Bombardier and rescinded the decision to ballot although we remain in dispute until these talks have concluded.

The Lead Officer has now received confirmation from management that they have agreed to discuss with BTUK how LUL staff will be more involved with air bag activities. The Company has no intention of Fleet staff taking over this air bag work as it is under warranty and BT is contractually obliged to carry out the work at its own cost. LUL has however agreed to have discussions on what would be required from Fleet staff in relation to air bags and this position is acceptable to the Fleet Reps.

This matter has been considered by the National Executive Committee and referred to the Southern Sub-Committee for further examination and report. I will keep Branches advised of all further developments.
